Privacy Policy

1. Privacy at a glance

General information

The following notes provide a simple overview of what happens to your personal data when you visit this website. Personal data is any data by which you can be personally identified. Detailed information on data protection can be found in the privacy policy below this text.

Data collection on this website

Who is responsible for data collection on this website?

Data processing on this website is carried out by the website operator. Their contact details can be found in the section "Controller" of this privacy policy.

How do we collect your data?

On the one hand, your data is collected when you provide it to us, e.g. by entering it in the contact form or in the PDF request form. Other data is collected automatically by our IT systems when you visit the website – mainly technical data (browser, operating system, time of access).

What do we use your data for?

Some data is collected to ensure the website is provided without errors. Data submitted via the forms is used exclusively to process your request or to send you the requested PDF. This website uses no analytics, tracking or advertising tools.

What rights do you have regarding your data?

You have the right at any time to receive free information about the origin, recipients and purpose of your stored personal data. You also have the right to request the rectification or erasure of this data. If you have given consent to data processing, you can revoke this consent at any time with effect for the future. You also have the right, under certain circumstances, to request the restriction of processing of your personal data, and the right to lodge a complaint with the competent supervisory authority. You can contact us at any time about this and other questions on data protection.

2. Hosting

We host the content of our website with the following provider:

All-Inkl

The provider is ALL-INKL.COM – Neue Medien Münnich, owner René Münnich, Hauptstraße 68, 02742 Friedersdorf, Germany (hereinafter All-Inkl). Details can be found in All-Inkl's privacy policy: https://all-inkl.com/datenschutzinformationen/.

All-Inkl is used on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in the most reliable presentation of our website possible.

Data processing agreement

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law, which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Server log files

The provider automatically collects and stores information in so-called server log files, which your browser transmits to us automatically: browser type and version, operating system used, referrer URL, host name of the accessing computer, time of the server request and IP address. This data is not merged with other data sources. Collection is based on Art. 6(1)(f) GDPR: the website operator has a legitimate interest in the technically error-free presentation and optimisation of the website.

3. General and mandatory information

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection regulations and this privacy policy.

We point out that data transmission over the Internet (e.g. when communicating by email) may have security gaps. Complete protection of data against access by third parties is not possible.

Controller

The controller responsible for data processing on this website is:

Tobias Mahlknecht – TM BRANDING
Zollstangenplatz 4
I-39100 Bolzano, Italy

Phone: +39 379 22 90 700
Email: hello@tm-branding.it

The controller is the natural or legal person who alone or jointly with others determines the purposes and means of processing personal data (e.g. names, email addresses, etc.).

Storage period

Unless a more specific storage period is stated in this privacy policy, your personal data remains with us until the purpose for data processing no longer applies. If you assert a legitimate request for erasure or revoke consent to data processing, your data will be erased unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, erasure takes place once these reasons cease to apply.

Legal bases for processing

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR if special categories of data are processed. If your data is required for the performance of a contract or pre-contractual measures, we process it on the basis of Art. 6(1)(b) GDPR. We also process your data where necessary to comply with a legal obligation (Art. 6(1)(c) GDPR) or on the basis of our legitimate interest (Art. 6(1)(f) GDPR). The legal bases applicable in each individual case are stated in the following paragraphs.

Data protection officer

We have appointed a data protection officer:

Tobias Mahlknecht
Phone: +39 379 22 90 700
Email: hello@tm-branding.it

Recipients of personal data

In the course of our business activities we work with various external parties; in some cases this requires the transfer of personal data to these parties. We only pass on personal data to external parties if this is necessary for the performance of a contract, if we are legally obliged to do so, if we have a legitimate interest under Art. 6(1)(f) GDPR or if another legal basis permits the transfer. When using processors, we only pass on personal data on the basis of a valid data processing agreement.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The lawfulness of data processing carried out until revocation remains unaffected.

Right to object (Art. 21 GDPR)

IF DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION UNDER ART. 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR SUCH MARKETING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING (OBJECTION UNDER ART. 21(2) GDPR).

Right to lodge a complaint with a supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or place of the alleged infringement. In Italy the competent authority is the Garante per la protezione dei dati personali (www.garanteprivacy.it). The right to lodge a complaint is without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a commonly used, machine-readable format. If you request direct transfer of the data to another controller, this will only be done where technically feasible.

Access, rectification and erasure

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of data processing and, if applicable, a right to rectification or erasure of this data.

Right to restriction of processing

You have the right to request the restriction of processing of your personal data. This right exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification you have the right to request restriction of processing.
  • If the processing of your personal data was/is unlawful, you can request restriction of processing instead of erasure.
  • If we no longer need your personal data but you need it to exercise, defend or assert legal claims, you have the right to request restriction of processing instead of erasure.
  • If you have lodged an objection under Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it has not been determined whose interests prevail, you have the right to request restriction of processing.

If you have restricted the processing of your personal data, this data may – apart from storage – only be processed with your consent or for the establishment, exercise or defence of legal claims, to protect the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.

SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, such as enquiries you send to us, this site uses SSL/TLS encryption. You can recognise an encrypted connection by the browser address bar changing from "http://" to "https://" and by the lock symbol. When encryption is active, the data you transmit to us cannot be read by third parties.

Objection to advertising emails

We hereby object to the use of contact data published under our imprint obligation for sending unsolicited advertising and information material. The operators of the pages expressly reserve the right to take legal action in the event of unsolicited advertising, e.g. spam emails.

4. Data collection on this website

Cookies and local storage

This website uses no tracking or marketing cookies and therefore no cookie banner. Only technically necessary elements are used:

  • Session cookie "evsid": only set when you use a form. It serves solely to protect the forms against misuse (CSRF protection) and is deleted when you close your browser.
  • Local storage "ev-lang": stores your language choice (DE/IT/EN) so the website appears in your preferred language on your next visit.
  • Local storage "ev-yt-consent": only set if you choose "Remember for all videos" when loading a YouTube video.

This storage is necessary for the functions you request and is based on Art. 6(1)(f) GDPR. You can delete the entries at any time via your browser settings.

Contact form and PDF request

If you send us enquiries via the contact form or request our information PDF via the form, your details from the form (name, email address, company, website and message where applicable), including the contact details you provide, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. The data is transmitted to us by email; no data is passed on to third parties. To protect against spam we use invisible form fields (honeypot), a time check and a limit on submission attempts; for this purpose your IP address is stored exclusively in hashed (non-traceable) form for a maximum of 20 minutes.

This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary for pre-contractual measures. In all other cases, processing is based on our legitimate interest in effectively handling enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), which can be revoked at any time.

The data you enter in the form remains with us until you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your enquiry has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Enquiries by email, phone or fax

If you contact us by email, phone or fax, your enquiry including all resulting personal data (name, enquiry) will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent. Processing is based on Art. 6(1)(b) GDPR, our legitimate interest (Art. 6(1)(f) GDPR) or your consent (Art. 6(1)(a) GDPR). The data remains with us until you ask us to delete it, revoke your consent or the purpose no longer applies; statutory retention periods remain unaffected.

Communication via WhatsApp

For communication with our customers and other third parties we use, among others, the instant messaging service WhatsApp in the "WhatsApp Business" version. The provider is WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. This website only contains a link to WhatsApp; data is only transmitted when you actively click this link.

Communication is end-to-end encrypted, preventing WhatsApp or third parties from accessing the content. However, WhatsApp receives metadata generated during communication (e.g. sender, recipient and time). WhatsApp states that it shares personal data of its users with its US parent company Meta. Further details: https://www.whatsapp.com/legal/#privacy-policy.

WhatsApp is used on the basis of our legitimate interest in the fastest and most effective communication possible with customers, prospects and partners (Art. 6(1)(f) GDPR). The company is certified under the "EU-US Data Privacy Framework" (DPF): https://www.dataprivacyframework.gov/participant/7735. Data transfer to the USA is based on the EU Commission's standard contractual clauses: https://www.whatsapp.com/legal/business-data-transfer-addendum.

5. Social media

Links to LinkedIn, YouTube and Google

This website only contains simple links to our profiles on LinkedIn (LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland), YouTube and Google Reviews (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). No plugins or social media elements that transmit data to these providers when the page loads are embedded. Data is only transmitted when you actively click one of these links; the respective provider's privacy policy then applies: LinkedIn, Google/YouTube.

6. Analytics tools and advertising

This website uses no analytics tools, no tracking and no advertising networks (e.g. Google Analytics, Google Tag Manager, Matomo, Google Ads, Meta Pixel).

7. Plugins and tools

YouTube with enhanced privacy mode (2-click solution)

This website embeds videos from YouTube. The operator is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

We use a 2-click solution: when the page loads, only a preview image stored locally on our server is displayed; no connection to YouTube is established. Only when you actively start a video and confirm the notice is the YouTube player loaded via the domain "youtube-nocookie.com" and a connection to YouTube's servers established. The YouTube server is informed which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your browsing behaviour directly to your personal profile; you can prevent this by logging out of your YouTube account.

We use YouTube in enhanced privacy mode. According to YouTube, videos played in this mode are not used to personalise browsing on YouTube and ads shown are not personalised. No cookies are set in this mode; however, local storage elements are stored in the browser which may contain personal data and be used for recognition. Details: https://support.google.com/youtube/answer/171780.

After activating a YouTube video, further data processing operations over which we have no influence may be triggered.

YouTube is used on the basis of your consent under Art. 6(1)(a) GDPR, which you give by actively starting a video. Consent can be revoked at any time; a stored consent ("Remember for all videos") can be withdrawn by deleting the local storage entry "ev-yt-consent" in your browser.

Further information on YouTube's privacy: https://policies.google.com/privacy?hl=en. The company is certified under the "EU-US Data Privacy Framework" (DPF): https://www.dataprivacyframework.gov/participant/5780.

Google Fonts (local hosting)

For uniform display of fonts, this site uses so-called Google Fonts (Bricolage Grotesque, Libre Baskerville). The fonts are installed locally; no connection to Google servers is established. More information: https://developers.google.com/fonts/faq.

Self-hosted videos

The background video in the header and the divider video are delivered from our own server. No data is transmitted to third parties.
